Environment 
The effects of environmental legislation are no longer just restricted to heavy industrial sectors but are felt across the wider business community. Clients of all descriptions face environmental concerns, particularly when they sell elements of their businesses or plan new developments. All organisations must meet strict regulatory standards.   
Additionally, land earmarked for potential development may be subject to a myriad of Environmental Designations. These include sites of Special Scientific Interest (SSSIs), Nature Reserves, Special Protection Areas (SPAs), Special Areas of Conservation (SACs) and Areas of Great Landscape Value. All of these designations are capable of having a severe disabling affect on the ability of landowners to develop their land. There is a limited right of objection against many of these designations and it is often worthwhile exercising this right if the designations will have an adverse effect on a particular project.
We have considerable expertise in advising on all environmental controls affecting land or buildings. Our planning and environment team has extensive experience of advising on management of environmental risks, corporate transactions involving land and liability issues arising out of environmental problems.

If a dispute arises, our team, in conjunction with our property litigation colleagues, work with clients from the outset to assemble and present the best case. We have considerable skill in developing strategies for defending prosecutions by statutory bodies.

Recent Experience

· Advising on Flood Risk Assessment, Environmental Impact Assessment, Mitigation concerns and habitats protection for the Waverley Railway line, linking Edinburgh to the Borders, and the Edinburgh Airport Railway Link (one of Scotland's largest infrastructure projects).

· Advising a construction company for an alleged breach of the Waste Management Regulations.

· Successfully defending a farmer in a prosecution for an alleged pollution incident.

· Advising the operators of a packaging waste recycling scheme regarding an alleged technical breach of packaging waste recycling certification scheme requirements.
