We frequently advise public bodies on general issues of compliance with freedom of information legislation, including the Freedom of Information (Scotland) Act 2002, the Freedom of Information Act 2000, the Environmental Information (Scotland) Regulations and the Environmental Information Regulations. We advise public authorities on the development and review of publications schemes and on compliance with specific duties, including dealing with requests for information, requests for reviews and where appeals have been made to the Scottish Information Commissioner of the UK Information Commissioner. We also advise applicants for information under FOI.
We have experience of acting for several public bodies in relation to statutory FOI appeals to the Court of Session against decisions of the Scottish Information Commissioner.
Our knowledge of FOI and our experience of statutory interpretation are effectively combined in identifying and correctly applying the exemptions to the rights of access, as contained in FOI legislation. We regularly provide training to public bodies to ensure start-up and ongoing compliance with all relevant information management legislation.
