Landlord and Tenant 
Many people know that Scots Law is different to the law in other parts of the UK. Landlord and Tenant Law holds a particular risk for the unwary. The form of lease document commonly used for commercial property leasing in Scotland bears close resemblance to the common form of Lease used in England and Wales but the similarity ends with the appearance as many have learnt to their cost.   
This is an area where the differences between the jurisdictions in the UK is most starkly demonstrated. There is nothing to fear, however, as long as the need for separate advice is understood.
We are experiencing a change in attitude to the traditional lease structure and the need for specialist advice on the way that trends in lease drafting is moving has never been more important.

This will not be an overnight revolution but will see priorities continue to shift to reflect the changing market conditions. This applies to the institutional investor lease as well as the small business lease. Flexibility is the keyword now, but knowing where it may be found depends on high level advice.
