Chambers 2009
Copyright is a highly unusual process. There is no formal registration process and yet it can be claimed for so many creative works. It is of enormous importance to the growing number of individuals and businesses whose earnings depend on creative expression. We have experienced specialists who can advise you on whether copyright exists in a particular work and if so who owns the copyright.
Copyright arises automatically for artistic, musical, dramatic or literary works (which includes software codes). However, copyright cannot be claimed in just anything and certain requirements must be met.
Our team deals with matters ranging from publishing agreements and licensing of copyright materials to copyright protection measures and infringement cases. We are also experienced in niche areas such as digital rights management (DRM).
Digital materials such as music CDs, software, e-books etc are increasingly vulnerable to unauthorised copying, distribution and exploitation to the loss of the copyright owner.
DRM is a relatively new area of work that deals with ensuring digital materials remain secure and cannot be unlawfully copied.
We can assist you in the protection and exploitation of software and the ongoing commercial arrangements involved in its use, including licensing and maintenance arrangements.
Whether a copyright issue affects a traditional area of creativity, like the printed work, or arises from the 21st century electronic revolution, our team is a leader in protecting the intellectual property of clients.
