Important Court decisions affecting Landlords and Tenants
Scottish Pre-Action Protocol in Personal Injury Cases - Rise in Fees
The Law Society of Scotland has recently announced that the instruction fee element of the Pre-Action Protocol is to increase by around 12%. The increase will take effect from 1 July 2009 and will apply to personal injury claims settling on or after that date.
The new rates for the instruction fees are as follows:
On settlements below £1,500 - £358 (previously £320)
On settlements over £1,500 - £783 (previously £700)
The new rates will run until 31 December 2010.
The sliding scale fees for negotiation/completion remain unchanged and are as follows:
On settlements up to £2,500 - 25%
On the excess over £2,500 up to £5,000 - 15%
On the excess over £5,000 up to £10,000 - 7.5%
On the excess over £10,000 up to £20,000 - 5%
On the excess over £20,000 - 2.5%
