- Dealt with the administration of an estate which involved negotiating with some of the UK’s leading charities to ensure they each received an equal share of the estate but that the principal beneficiary, the Royal National Lifeboat Institution, received a sufficient legacy to construct a new lifeboat.
- Involved in setting up an additional Private Open Ended Investment Company (POEIC) for a group of investors in order to achieve tax advantages and also greater flexibility in the investment management for the individual members. This was a major restructuring exercise of the family’s investments, which has achieved a more appropriate asset breakdown and will assist in providing better financial planning and reporting in the future. The project was completed within the required timescale and budget, resulting in very positive feedback from the clients.
- Acted in the first ever appeal from a decision of The Office of the Scottish Charity Regulator (OSCR) to the dedicated Scottish Charity Appeals Panel (SCAP). The appeal related to (1) whether OSCR was correct in its adjudication over the use of a charity name and (2) whether OSCR had dealt fairly with the charity in relation to the second ground of appeal and was successful. This is an important decision because OSCR accepted that it must review and improve its procedures.
